Embedded in primary research while also drawing heavily on the existing literature on antisemitism, the article seeks to make an intervention into the historiography of antisemitism and to argue for the existence of a sexual component at the heart of antisemitism, both historically and today. The article starts by briefly discussing a very short and specific story from Irish Jewish history in the 1900s, and then moves to a seemingly very unconnected story about the vocabulary of twenty-first-century American politics. whales (Artiodactyla: Odontoceti)", "subtitle": null, "abstract": "The temporalis is an important muscle used in biting and mastication, and whose morphology is strongly influenced by feeding ecology. Although the anatomy of this muscle and its relation to feeding function are well-studied in terrestrial mammals, few studies have examined its variation in whales. Our study focuses on quantifying the area of attachment for the temporalis muscle within the temporal fossa, calculating two metrics of comparison: A temporal fossa index (TFI) which is a size corrected measure of temporalis muscle attachment area, and a corrected temporal fossa index (CTFI), which also corrects for cranial telescoping. We calculated TFI and CTFI scores for 72 species of extant odontocetes as well as 37 species of extinct whale, including archaeocetes and toothed mysticetes. We statistically tested for differences related to diet and prey capture method using ANOVA. We then performed ancestral character state reconstruction (ACSR) for both metrics.\n \nWe found no significant differences in TFI scores for diet, however both grip-and-tear and snap feeding taxa had significantly larger TFI scores than suction or ram feeding odontocetes. The ACSR found major decreases in TFI at the base of the Neoceti, Odontoceti, and just prior to the evolution of the crown group, relating to the gradual loss of mastication. When we corrected for telescoping, CTFI scores increase within mysticetes and stem odontocetes, before decreasing again within crown odontocetes. This suggests that as telescoping increased, some compensation was needed to account for the reduced intertemporal region. We find evidence of macropredatory behavior for \nBasilosaurus\n, \nCoronodon\n, \nAnkylorhiza\n, \nLivyatan\n, and possibly \nAtocetus\n. Hyper-longirostrine taxa such as eurhinodelphinids possess unusually low TFI scores, as does the bizarre prognathous porpoise \nSemirostrum\n, highlighting their unique feeding styles. Sanofi. The Court unanimously affirmed the Federal Circuit’s holding that certain functional patent claims directed to a class of monoclonal antibodies were invalid for lack of enablement under 35 U.S.C. §112(a). After Amgen, innovators of these astounding medicines are caught between a rock and a hard place: The Court’s enablement standard is clear enough, but the current state of the art, saddled with inherent unpredictability, makes it operationally impossible for applicants to satisfy that standard when they attempt to claim more than a handful of discrete antibodies.</p>\n<p>The upshot is an antibody patent singularity—applicants can enable, and thus claim, only the individual antibody structures they actually make, test, and disclose. And yet, a routine practice in the art called conservative replacement permits scientists to exploit known antibody structures to create literally noninfringing competitor antibodies whose properties may be identical to therapies already on the market. One way to counteract this decimation of the literal scope of antibody patents is through the doctrine of equivalents. Therapeutic antibody patent holders will likely assert infringement by equivalents of their narrowed claims against competing antibodies. Courts, however, lack a robust framework to guide the antibody equivalents analysis. Without such a framework, the analysis suffers and leads to undesirable outcomes that hamper innovation.</p>\n<p>To prevent antibody innovation from stalling, the clinical properties of antibodies—not their molecular structures—should be the primary determinant of structural therapeutic antibody equivalents. Incorporating clinical data into the infringement inquiry hardly changes the analysis. It merely permits patent holders to assert infringement against other antibody therapeutics that perform the same function in the same way to achieve the same result. This analysis complies with the core tenets of patent law and the doctrine of equivalents. Here, the Article spotlights how incidents caused by AI-driven space objects can raise complex accountability issues. Our\nprevious empirical research demonstrated that a defendant’s race and class do not affect prosecutorial charging decisions and revealed a gap in the literature about factors that do\ninfluence prosecutorial charging decisions and sentencing recommendations. Accordingly, we designed a study to obtain more information about prosecutor discretion and decision-making.\nOver 500 prosecutors from across the United States completed our vignette-based experiment and survey, which produced quantitative and qualitative data. We transformed these data to\nuse Correspondence Analysis (CA), an empirical method that allowed us to identify associations between prosecutors’ charging decisions and sentencing recommendations for a\nhypothetical defendant and the prosecutors’ individual characteristics, office and jurisdiction characteristics, and the factors they described as important to their decision-making. Our analysis shows two dimensions of prosecutor decisions—Punitive vs. Therapeutic Sentence and Most Severe Criminal Record vs. Least Severe Criminal Record—and we mapped the prosecutor decisions onto these dimensions. Unwed women are recognized as mothers automatically upon birth, while unwed men must undertake a series of affirmative steps before being recognized as fathers. One of the central rationales for this differential treatment is the Court’s concern with problems of proof and potential for fraud that plague paternity, but not maternity, determinations. Legal scholarship has been rightly critical of these enduring sex-based distinctions, but it has largely ignored the role that fraud plays in these cases and in the broader regulation of nonmarriage. That is the task of this Article.</p><p>This Article engages in a close reading of the Supreme Court’s use of fraud across a range of opinions—from addressing state law rules setting out property rights at death to federal laws dictating the transmission of citizenship at birth. The presence of fraud in the Court’s reasoning is significant, but the way it functions is neither obvious nor straightforward. The Court claims to be concerned with “paternity fraud,” which takes place when there is no biological connection between alleged father and child. Yet not a single decision involves a missing genetic link, and the Court’s accepted response to the fraud routinely fails to require proof of one. This Article argues that the concern articulated in the language of paternity is, in fact, a concern over the lack of marriage between the father and mother. As such, what the Court presents as an objective rationale based on biology is, in fact, a subjective and value-laden determination about what kinds of relationships the law should recognize.</p><p>Exposing the work of fraud matters. At a minimum, it shows that the purported governmental interest in fraud prevention is not legitimate and should no longer count as an uncontroversial reason to support the constitutionality of distinguishing between men and women in their roles as fathers and mothers. Paying attention to how fraud functions demonstrates that such distinctions are based on the legacy of contestable legal rules rather than, as the Court claims, any inherent biological difference. More broadly, this Article exposes how appeals to fraud transform what are disputable normative judgments into empirical-sounding evidentiary concerns. Fraud, however, is anything but neutral. It perpetuates a gendered state of affairs that casts women as mothers always and men as fathers only within marriage. It also functions in racist ways and has long been leveled against nonwhite families. Rather than protect that protest as necessary to engender solidarity and organizing, current labor doctrine offers employers various opportunities to fire workplace agitators. Focusing on nonunion workers standing up to management, this Article offers three key insights into U.S. labor law. First, it draws on social movements to confirm strife’s vital but uneasy role in workplace solidarity. Second, it unearths the NLRA’s original intention to protect the co-constitutive roles of strife and industrial peace. The New Dealers viewed conflict as a short-term step toward achieving collective bargaining’s peaceful dispute resolution. Third, it shows how the United States Supreme Court and National Labor Relations Board (NLRB) misconstrue the NLRA’s industrial peace objective as both the means and the ends of labor relations, to the detriment of strife and the solidarity it generates. Beaudreaux, the Supreme Court, while purporting merely to summarize prior caselaw, articulated a constitutional standard for assessing eyewitness\nidentification evidence that distorted the Court’s earlier due process jurisprudence and posed a serious—and until now largely unrecognized—threat to the truth-seeking function of the\ncriminal justice system. Previously, the Court had used a relatively straightforward, two-part test for evaluating the constitutional admissibility of eyewitness evidence: First, the defendant\nwas required to prove that police used an identification procedure that suggested the identity of the suspect and that police lacked any reasonable justification for failing to employ a more\nreliable procedure; second, if the defendant succeeded in showing that law enforcement used an “unnecessarily suggestive” procedure, the court should evaluate a series of ostensibly\nindependent reliability factors to determine whether the suggestive procedure gave rise to a “substantial likelihood of misidentification.” In Beaudreaux, however, the Court asserted\nthat “unnecessary suggestion” means something more than suggestion that is unnecessary; instead, the Court concluded that judges should find an identification procedure to be\nunnecessarily suggestive only if the procedure was so egregiously defective that the court could conclude, even before evaluating the reliability factors, that the procedure gave rise to a high\nprobability of misidentification. States are legislating at a breakneck pace to protect children. Courts strike down every attempt to intervene on First Amendment grounds. This Article clears a path through this stalemate by leveraging two underappreciated frameworks: the latent regulatory power of parental authority arising out of family law and a hidden family law within First Amendment jurisprudence. These two projects yield novel insights. First, the recent cases offer a dangerous understanding of the First Amendment, one that should not survive the family law reasoning we provide. First Amendment jurisprudence routinely defers to parental decisions, in contrast to emerging case law. Second, existing legislation fails to leverage family law to bypass First Amendment barriers. Lawmakers should refocus on legislating to empower parents to supervise their children meaningfully on social media, instead of focusing on harmful content itself. In the real world, parents enjoy nearly unlimited authority to decide how much privacy to afford a minor, what ideas may reach them, and who may contact them. The law supports parents in these efforts, and it can do so in the social media context as well. But it is essential for the state to identify this as the interest behind regulation in order to survive First Amendment challenges. The site of this activation of viewers’ mnemonic faculty is a particular segment of Havarie that, while frequently noted, has yet to attract sustained analysis—the mid-film pan, during which the camera temporarily relinquishes its gaze onto the migrants and turns towards the cruise ship from where the filming proceeds.\nThe present essay centrally concerns itself with a discussion of this pan and how it subverts the Eurocentric looking relations in which the film partakes. that questiontraditional models of validity and objectivity (Huot, 2002; Lynne, 2004) toscholarship that exposes how traditional assessment perpetuates inequality(Inoue 2015, 2019) and advocates new approaches that take social justice astheir central goal (Poe, et. al., 2018). We report on a collaboration betweentwo writing instructors and one librarian that assessed first-year writing(FYW) students' information literacy when researching and writing with popularnews sources. In addition to the typical practice of analyzing students'written work, this project used interviews as an assessment methodology. Thisresearch produced three important findings: 1) minoritized studentsdemonstrated superior critical information literacy skills compared tomajoritized students; 2) these differences were made visible through the use ofmultiple measures (written artifacts and interviews); and 3) the use ofinterviews is an assessment methodology that invites students to engage incounterstory and draw on personal experiences, revealing new sources ofknowledge and countering narratives of deficit. It also provides anesthesia to more nerves that innervate the anterior capsule of the femoroacetabular joint when compared to the femoral nerve and fascia iliaca blocks. We describe an individual-based ecological particle tracking model (ECO-PTM) that can be used to assess the efficacy of proposed actions. Based on a random walk theory, the model tracks individual particles’ travel time, routing and survival in a flow field simulated by the Delta Simulation Model 2 hydrodynamic module (DSM2 HYDRO). The random walk particles are parameterized to have fish-like swimming behaviors, including upstream/downstream swimming, probabilistic holding behaviors, and stochastic swimming velocities. Particle routing at key junctions is based on well-established statistical models, and route-specific survival is calculated using the XT mean free-path length model. Behavioral parameters were estimated by fitting several competing models to a multiyear dataset of travel times from acoustic tagged juvenile salmon. The model’s baseline simulations under historical flow conditions from 1991 to 2016 successfully replicated essential relationships between salmon outmigration survival and hydrodynamic conditions, consistent with previous studies and the STARS (Survival Travel Time and Routing Simulation) statistical simulation model. Simulation results for management scenarios revealed multifaceted influences on fish survival, including Delta flow, flow at key junctions, route alterations, seasons, and water availability characteristics. Deeply subsided islands limit the potential for tidal wetland restoration. Floating peats may offer an opportunity to create tidal habitat in the subsided western and central Delta. We conducted a mesocosm experiment to assess the feasibility of floating peat blocks, and the potential food-web benefits, biomass production, carbon sequestration, methane emissions, and water-quality effects. We evaluated the effect of varying water residence time and initial peat-block density.\nThe peat blocks floated during the entire experiment, and accreted biomass at rates consistent with those reported for Delta non-tidal managed wetlands. Peat blocks placed in mesocosms with 45% open water expanded horizontally about 21% per year. We estimated average vertical accretion rates of 5.5 to 8.6 cm/yr for all the mesocosms. Vertical and horizontal expansion increase floating peat-block stability.\nWe measured a 3-fold zooplankton population increase during the first year after deployment, relative to the Mokelumne River, which was the mesocosm’s water source. Measured and modeled methane emissions were lower than those reported in Delta non-tidal managed wetlands. Aqueous methane concentrations and methane fluxes were significantly lower for the shorter water-residence-time of about 5 days compared to longer residence times of about 11 days. Elevated dissolved oxygen (DO) concentrations generally corresponded with low methane concentrations. Our estimated net ecosystem carbon balance of – 820 +/– 137 g C m2/yr indicates that the floating wetlands are potentially greater carbon sinks than Delta non-tidal wetlands. Nitrogen data indicated consumption by wetland plants, and denitrification and dissimilatory nitrate reduction in the mesocosms. Despite this, the US physician workforce, particularly in emergency medicine (EM), remains relatively homogeneous. Of all Black medical school students in the US, 14% attend the four Historically Black Colleges and Universities (HBCU) that have a medical school. Unfortunately, none of these schools are affiliated with an academic EM program. Because of this, there is less professional mentorship focused on obtaining a career in EM and potentially less formal curricula for senior medical students doing their home sub-internship in EM.</p>\n<p><strong>Objectives:</strong> Our objective was to fill the gap left by the absence of an academic EM department at Howard University College of Medicine (HUCOM) by creating a collaborative educational experience for fourth-year medical students during their home EM sub-internship. The curricular objectives were to teach core principles of EM, build relationships with students, and prepare them for pursuing EM residency training.</p>\n<p><strong>Curricular Design: </strong>Four EM academic departments collaborated to create and implement a virtual curriculum using the six-step approach to curricular development.</p>\n<p><strong>Impact/Effectiveness:</strong> After completion of the course, five students (100%) reported strongly agreeing with the following statements. These sessions 1) helped me learn the approach to core EM topics more than I would have been able to do on my own; 2) helped me learn key skills for excelling in an EM rotation more than I would have been able to do on my own; and 3) allowed me to connect with faculty and resident mentors to learn more about the field of EM. violation, and dehumanization. In this article, we argue that there are limits to relying on conventional safety tools and protocols to ensure players are protected from emotional harm and trauma of bleed-out experiences during tabletop role play. We argue that actual play can reveal the limits of conventional TTRPG safety tools like the X card or lines and veils. We analyze a case study of an in-game sexual assault that precipitated the cancellation of the Far Verona stream. We examine the accounts given by players and GM after the event but zoom in on the sequential action of the live-streamed play itself. We first orient the reader with the mathematical probability of critical successes and critical failures in several different tabletop game systems. For critical rolls, we examine D&D 5th Edition, Cyberpunk, Deadlands and Shadowrun. Then we compare the likelihood of a low-level combat-oriented character hitting their opponent across different systems. Our in-depth analysis includes D&D, Deadlands and Sword Chronicle. Games are rule bound systems and the random number generators selected for a TTRPG system and the parameters placed around those generators have a significant impact on the player experience. This analysis can help designers and players be more aware of their probabilities of hitting, and how these percentages change based on the gaming system that they are running.
